Second Circuit upholds NYC FARE Act broker-fee ban
Real Estate Board of New York, Inc. v. City of New York, No. 25-1506 (2d Cir. July 13, 2026) (Parker, Livingston, Kahn, JJ.): affirmed dismissal of the First Amendment challenge to NYC's Fairness in Apartment Rental Expenses Act (intermediate scrutiny satisfied) and affirmed denial of a preliminary injunction on the Contracts Clause claim. Landlords who hire the broker pay the broker; tenants cannot be charged that fee.
